GOKantan – Terms of Use and End User License Agreement (EULA)

Important Notice
Please read these Terms of Use and End User License Agreement ("Terms") carefully before using the GOKantan mobile application, website, and related services (collectively, the "Services").
These Terms form a binding legal agreement between you ("User") and Legacy Keystone Sdn Bhd ("GOKantan", "Company", "we", "our", or "us").
By downloading, installing, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.
1. Eligibility and Acceptance
You must be at least 18 years old, or the legal age of majority in your jurisdiction, to use the Services.
By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.
If you access or use the Services on behalf of another person, company, or organization, you represent and warrant that you have the authority to bind that person, company, or organization to these Terms.
2. License Grant
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, access, and use the Services solely for your personal and non-commercial purposes.
Except as expressly permitted by applicable law or with our prior written consent, you may not copy, modify, distribute, sell, lease, rent, sublicense, reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Services.
3. User Responsibilities
You agree that you will not:
Use the Services for any unlawful, fraudulent, harmful, or unauthorized purpose.
Interfere with, disrupt, damage, or compromise the operation, security, or integrity of the Services or related systems and networks.
Attempt to gain unauthorized access to any accounts, systems, networks, or data associated with the Services.
Upload, transmit, distribute, or introduce any malicious code, viruses, malware, or other harmful materials.
Violate any applicable laws, regulations, or the rights of others when using the Services.
Use the Services in any manner that could impair, disable, overburden, or adversely affect the Services or other users.
Feedback and Suggestions
If you provide feedback, suggestions, ideas, recommendations, or other comments relating to the Services, you grant us the right to use, modify, implement, and incorporate such feedback for any purpose without restriction or obligation to compensate you, except where prohibited by applicable law.
4. Content and Intellectual Property
The Services, including all software, technology, content, designs, graphics, logos, trademarks, text, features, functionality, and other intellectual property rights, are owned by or licensed to the Company and are protected by applicable intellectual property laws.
Except as expressly provided in these Terms, nothing grants you any ownership rights in the Services or any associated intellectual property.
Any content that you create, upload, submit, or store through the Services, including trip notes, preferences, and itinerary-related information ("User Content"), remains your property.
By submitting or storing User Content through the Services, you grant the Company a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, process, and display such User Content solely for the purpose of operating, maintaining, improving, and providing the Services.
Any personal information contained within User Content will be collected, used, and protected in accordance with our Privacy Policy.
5. Purchases and Payments
Certain features of the Services may require the purchase of a Trip Pass or other paid features. By making a purchase, you agree to the applicable pricing, payment terms, and any relevant rules imposed by the Apple App Store, Google Play, or other authorized distribution platforms.
All purchases are processed by the relevant app store or payment provider. We do not collect, process, or store your credit card, debit card, or other payment card details.
Access to paid features is subject to successful payment processing and verification by the relevant platform.
Refund requests, cancellations, and payment disputes are generally governed by the policies of the platform through which the purchase was made, unless otherwise stated by us.
We reserve the right to modify pricing, introduce new paid features, or discontinue existing paid features at any time, subject to applicable laws and platform requirements.
6. Third-Party Services
The Services may integrate with or provide access to third-party services, platforms, content, or tools, including mapping services, navigation services, travel-related data providers, analytics providers, payment platforms, and other external services.
We do not own, operate, or control third-party services and are not responsible for their availability, content, accuracy, security, or practices.
Your use of any third-party service is subject to the applicable terms, conditions, and privacy policies of the relevant third party.
We are not liable for any loss, damage, or issues arising from your use of third-party services, except where such liability cannot be excluded under applicable law.
Any personal information shared with or processed by third-party services will be handled in accordance with our Privacy Policy and the applicable privacy policies of those third parties.
7. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis without any warranties, representations, or guarantees of any kind, whether express, implied, statutory, or otherwise.
To the fullest extent permitted by applicable law, we do not warrant that the Services will be uninterrupted, error-free, secure, accurate, reliable, complete, or free from defects, viruses, or other harmful components.
We do not guarantee the accuracy, completeness, availability, or suitability of any itinerary recommendations, travel information, points of interest, opening hours, navigation information, third-party content, or other information provided through the Services.
Your use of the Services is at your own risk. You are responsible for independently verifying information and making your own travel, transportation, accommodation, and activity decisions.
8. Limitation of Liability
To the fullest extent permitted by applicable law, the Company and its directors, officers, employees, affiliates, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of data, revenue, profits, business opportunities, goodwill, or other intangible losses arising out of or relating to the Services.
To the fullest extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Services shall not exceed the greater of:
(i) USD $50; or
(ii) the total amount paid by you to the Company through the Services during the six (6) months immediately preceding the event giving rise to the claim.
The limitations and exclusions contained in these Terms apply regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise.
Some jurisdictions do not allow the exclusion or limitation of certain liabilities. In such cases, the limitations and exclusions in these Terms shall apply only to the maximum extent permitted by applicable law.
9. Termination
We may suspend, restrict, or terminate your access to the Services at any time if we reasonably believe that you have violated these Terms, engaged in unlawful or harmful conduct, or where such action is required by applicable law, regulation, or legal process.
Upon suspension or termination, your right and license to access or use the Services will immediately cease.
Termination of your access to the Services does not relieve you of any obligations incurred prior to termination.
Any provisions of these Terms that by their nature should survive termination shall remain in effect following termination, including provisions relating to intellectual property, user responsibilities, disclaimers, limitation of liability, dispute resolution, and privacy.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles.
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Services, the parties agree to first attempt to resolve the matter amicably through good-faith discussions.
If the dispute cannot be resolved amicably, it shall be submitted to the exclusive jurisdiction of the courts of Singapore.
11. Changes to These Terms
We may modify or update these Terms from time to time to reflect changes in our Services, legal requirements, operational practices, or business needs.
When we make material changes to these Terms, we may provide notice through the Services, by email, or through other reasonable means where appropriate.
The "Last Updated" date at the top of these Terms indicates when the most recent changes were made.
Your continued access to or use of the Services after any updated Terms become effective constitutes your acceptance of the revised Terms.
If any changes affect how we collect, use, disclose, or protect personal information, such changes will also be addressed in our Privacy Policy.
12. App Store Terms
These Terms are concluded solely between you and the Company, and not with Apple Inc., Google LLC, or their respective affiliates.
Apple and Google are not responsible for the Services, including their operation, maintenance, support, content, or any claims relating to the Services.
To the extent permitted by applicable law, Apple and Google have no obligation to provide maintenance, support, or other services relating to the Services.
You acknowledge that Apple and Google are third-party beneficiaries of these Terms and may enforce those provisions of these Terms that relate to their rights as third-party beneficiaries.
Your use of the Services must also comply with any applicable terms, policies, and requirements imposed by the Apple App Store, Google Play, or other authorized distribution platforms through which the Services are made available.
